By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. 2. Age Restrictions

The Website and Services are also designed for use by student users. You must be at least 13 years old - or have the consent of a parent or legal guardian - to be able to register for Aww – A web whiteboard. By registering you confirm that you are either aged 13 or older or that your parent or legal guardian read and agrees to this terms of service on your behalf.

3. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Aww's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on Aww's web site;
  4. remove any copyright or other proprietary notations from the materials; or

By Submitting User Submissions on the Site or otherwise through the Service, you are granting the Company, affiliates, successors and assigns, a worldwide, non-exclusive, perpetual, fully paid, royalty-free licence to use, reproduce, publish, transmit, prepare derivative works of, publicly display and perform the User Submissions, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

You represent and warrant, and can demonstrate to Company’s full satisfaction upon request that you (i) own or otherwise control all rights to all content in your User Submissions, or that the content in such User Submissions is in the public domain, (ii) you have full authority to act on behalf of any and all owners of any right, title or interest in and to any content in your User Submissions to use such content as contemplated by these Terms of Use and to grant the license rights set forth above, (iii) you have the permission to use the name and likeness of each identifiable individual person and to use such individual’s identifying or personal information as contemplated by these Terms of Use; and (iv) you are authorized to grant all of the aforementioned rights to the User Submissions to Company and all users of the Service.

You represent and warrant that the use or other exploitation of such User Submissions by Company and use or other exploitation by users of the Site and Service as contemplated by this Agreement will not infringe or violate the rights of any third party, including without limitation any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.

When you publish User Submissions using the public setting, it means that you are allowing everyone, including people off of Educreations, to access and use that content, and to associate it with you (i.e. your name and profile picture).

5. Disclaimer

The materials on Aww's web site are provided "as is". Aww makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Aww does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall Aww or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Aww's Internet site, even if Aww or a Aww authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

impersonates any person or entity, including any employee or representative of Company.

Additionally, you shall not: (i) take any action that imposes or may impose (as determined by Company in its sole discretion) an unreasonable or disproportionately large load on Company’s (or its third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; (iii) bypass any measures Company may use to prevent or restrict access to the Service (or other accounts, computer systems or networks connected to the Service); (iv) run Maillist, Listserv, any form of auto-responder or "spam" on the Service; or (v) use manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Site.

Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate, disclose and make use of personal information. The following outlines our privacy policy.

Collecting Information

We ask for user’s e-mail address when registering on AWW web page or signing up for AWW newsletter. If a user chooses to register via social network, we may collect name of the user if that is provided by the specific social network.

Before or at the time of collecting personal information, we will identify the purposes for which information is being collected. If it is not identified, than the purpose is for sending important information via email about the updates of the application. These emails can be stopped at any time by clicking the unsubscribe button in the email itself. We will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.

Only AWW employees and user itself have access to user’s personal information.

We will only retain personal information for a period of time when user actively uses awwapp.com page or reads our newsletters. In the case that user doesn’t delete its account or unsubscribes from receiving newsletters personally, we will delete all personal information about inactive users after 6 months of inactivity.

Cookie policy

We use cookies when you are logged in so that we can remember this fact. This prevents you from having to log in every single time you visit a new page. These cookies are typically removed or cleared when you log out to ensure that you can only access restricted features and areas when logged in.

We are actively working on ensuring security and confidentiality of user data (by using encrypted communication and following other security best practices). If an unauthorised release of data on our site happens (during hacker or other software attack) we will notify all our users as soon as we acknowledge the leak of the data. For legal guardian to be notified, we recommend his or hers signup to be notify in the case of data leakage.

We will make readily available to customers information about our policies and practices relating to the management of personal information.


All data we receive from the user can be reviewed and changed on the request of the user or his/hers legal guardian in the user’s account details.

All users data can be deleted on the request of educational institution in which the user is using AWW, user’s parent, legal guardian or the user himself. To erase all users data from AWW, one can delete his or hers account by going to the account details and clicking the red "Delete account" button.

Sharing information

All users data on awwapp.com or any of it's subdirectories is not in the property of the software on any electronic service contractor.

We may share information with those that provide us with technology services (e.g. web hosting and analytics services), but strictly for the purpose of carrying out their work for us.

We may be required to share information with law enforcement or other third parties when compelled to do so by court order or other legal process, to comply with statutes or regulations, to enforce our Terms of Use, or if we believe in good faith that the disclosure is necessary to protect the rights, property or personal safety of our users.

Personal Information and other data we collect may be transferred to another company that has acquired our stock or assets, for example, as a result of a sale, merger, reorganization, dissolution or liquidation.

Under no circumstances should we share personal information of our users with other third parties than that mentioned above. This include advertising agencies, distributors, resellers, affiliates and ambassadors.

Compliances

AWW supports Family Educational Rights and Privacy Act of 1974 (FERPA). All parent or legal guardian permissions are required to be collected by the school or educational institution in which AWW is used.

AWW supports Children Online Privacy Protection Act of 1996. (COPPA) and does not knowingly collect any information from children under the age of 13 unless the School has obtained appropriate parental consent for the student to use the Service. When registering on awwapp.com user must confirm that he or she is over 13. Please contact us at dorotea@awwapp.com if you believe we have inadvertently collected personal information of a child under 13 without proper parental consents so that we may delete such data as soon as possible.
